The text amends the Social Security Benefits Act (Law 8213/91) and is analyzed by the House of Representatives. Under the proposal, private retirement is guaranteed for health professionals who voluntarily return to practice the profession, even after the benefit has been granted.

Private retirement for health workers

Under the current rule, private retirement can be granted to professionals who worked in circumstances that put their lives and health at risk. For example, in the case of exposure to factors harmful to health, such as heat or noise, with exposure levels above the limits established by specific legislation.

Private retirement is released after the worker has completed between 15 and 25 years of contribution. The rule also requires the worker to have practiced the profession for at least 180 months.

The author of Bell 1665/22 is Deputy Sergeant Alexander (Pode-SP). According to him, those who work in unhealthy or dangerous conditions have to choose between continuing the activity or requesting private retirement. This applies to health professionals.

Many choose the private retirement benefit and put aside activity, due to exposure to harmful biological factors. That is why, according to the deputy, there is a shortage the doctors and nurses.

He considered that “Brazil is currently suffering from an unprecedented health crisis, as the Covid-19 virus has destabilized the country and required several emergency measures to avoid chaos.”
