Among the advantages of assisted temporary disability (Paid sick leave) and permanent disability assistance (disability pension). However, it should be noted that people with critical illnesses, such as cancer, do not need proof of contribution for 12 months, but must prove that they contributed in the last year before they became ill.
Calculation
The benefit amount is calculated from the average of the last 12 contributions made by the beneficiary. In this sense, the lowest benefit value will be the minimum wage and the maximum cap must be respected INSSwhich is currently R$ 7087.22.
When it comes to the duration of the benefit, it is valid for the duration of incapacity to work in the case of temporary grants. Where the disability is permanent, every two years the beneficiary needs to be reassessed by the INSS to prove the disability.
Diseases exempt from the grace period
As explained earlier, some illnesses allow the beneficiary not to prove 12 months of subscription. This is not the case with pre-existing diseases, for example.
The critical illnesses currently excluded are:
- active tuberculosis
- leprosy;
- mental alienation
- multiple sclerosis;
- severe liver disease;
- malignant neoplasms (cancers);
- blindness.
- Irreversible and incapacitating paralysis.
- severe heart disease.
- Parkinson’s disease;
- Ankylosing spondylitis.
- severe nephropathy;
- advanced stage of Paget’s disease (osteomyelitis deforming);
- acquired immunodeficiency syndrome (AIDS);
- Radioactive contamination, based on the conclusion of specialized medicine
It is worth noting that the disease in itself is not deserving of the benefit, but rather the disabling disease. On the other hand, in cases of children or informal workers who prove a long-term disability (diseases leading to disability for at least two years) and who belong to a low-income family, they can receive the Continuing Cash Grant (BPC). It has a monthly minimum wage value of 1, below 13.
How to apply for benefits
To request benefits, you need to activate the INSS through the channels: Phone 135, MY INSS or through Digital INSS, via a lawyer. Therefore, it is important to stress that certificates and examinations that prove the disease are necessary.
However, in the absence of a prior contribution, the citizen should look for the Reference Center for Social Assistance (CRAS) for more information.
