Did you earn money? can appeal

Workers not covered by the salary bonus PIS / Pasepbase year 2020, but they understand they have a right to benefit, they can now appeal to the Ministry of Labor and Welfare to try and get the money.

Questions should be asked via email, through regional labor departments. The email address is practically the same for all states, it is only necessary to add the UF (Union of Federation) corresponding to the state in which you live. In São Paulo, for example, the email address is [email protected]; in Amazonas, [email protected]; In Pernambuco, [email protected]. (See more instructions below)

The appeal review period is “about 45 days,” according to the Labor Department.

This year, the allowance payments Started in February. The last group to receive private sector workers was born in December. Awarded March 31st. All beneficiaries can withdraw funds until December 29.

guiding rules

In the email that will be sent to your state’s regional labor watchdog, the worker must include:

  • Full name;
  • date of Birth;
  • CPF.
  • If applicable, PIS (Private Sector) or Pasep (Public Officials) registration number.

In addition, the appeal must include “text and documentary evidence proving the right to a salary bonus,” as the Department of Labor explained to UOL. That is: the worker must prove that he has been enrolled in PIS/Pasep for at least five years; who earned minimum wages per month, on average, in 2020; who worked for at least 30 days in 2020.

He added, “An analysis of the appeal will assess any inconsistency in processing, when the correct transfer of the business relationship occurs, the obligation of which falls entirely on the employer.”

Workers who may not have access to the Internet may file the appeal in one of the units of the territorial labor control body in their state, in person, by appointment.

Preselection

The federal government still advises workers to check all possible channels to confirm whether or not they have received the allowance before filing an appeal. “There are cases where the allowance is deposited, but the beneficiaries do not specify the receipt in their accounts,” the Ministry of Labor said in a note posted on its official website.

Allocations are always paid by Caixa Econômica Federal (PIS, private initiative) and Banco do Brasil (BASSand public officials).

Caixa makes deposits directly into a checking account, savings account, or digital social savings account. If none of these alternatives are available, credit can be withdrawn at branches and lottery outlets through self-service and Caixa Aqui.

On the other hand, BB account holders have their benefits available directly on their account. The allowance can also be withdrawn at any branch of the bank.

What about the 2019 allowance?

At this time, regional regulators will analyze applications that refer only to the 2020 base year allowance.

“For possible resources on the 2019 base year salary allowance, the Ministry of Labor and Pensions has contacted Dataprev to develop and adapt jobs in the new system. The company will provide the Ministry, until May 31, the technological solution to open and analyze these administrative resources,” informs the Federal Government.

Who has the right?

All private sector workers and public employees who earned the minimum monthly wage at least twice, on average, in 2020 are entitled to the allowance in 2022. Citizens also need to be registered with PIS or Pasep for at least five years.

In the case of private sector workers, specifically, it is also necessary to work on an official contract for at least 30 days in 2020.

All citizens still need to have their data properly reported by their employer to the government.

They are not entitled to the allowance:

  • domestic servants and maids;
  • rural workers employed by individuals;
  • urban workers employed by individuals;
  • Employees of a natural person equivalent to a legal entity.

What is the value?

The amount of the allowance is proportional to the period during which the worker worked under an official contract in 2020. Each month of work is equivalent to a benefit of R$101.

Therefore, to find out how much they will receive, it is enough for the worker to multiply the number of months in which he received an official contract in 2020 by R$101. Periods equal to or greater than 15 days are considered a full month.

The maximum benefit, which equates to 12 months of employment, is the minimum wage. It should be noted that the reference is the national minimum in force at the date of payment and not in the base year. In other words: Although the minimum wage was lower in 2020 (1,045 R$), those entitled to the maximum benefit will now receive R$1,212, which is the current value.
