Alerj Goes to Court Against CPI Suspension for Health Plans

the Legislative Assembly of Rio de Janeiro On Tuesday, 24th, Allerg filed a regulatory appeal against the initial decision of the Rio de Janeiro Court of Justice (TJRJ). The decision temporarily suspended the work of the Parliamentary Commission of Inquiry (CPI), which was intended to investigate irregularities in health plans for people with disabilities.

Alerj President and Deputy Rodrigo Bacellar (União-RJ) and CPI members expressed their opposition to the injunction. Judge Cintia Santarém Cardinale issued the measure last Thursday the 19th.

Rep. Fred Pacheco (PMN-RJ), president of the CPI, stated that Aliraj must abide by the court’s decisions. However, he thanked the Attorney General’s Office in Alaj for taking all appropriate legal action against the decision.

Rodrigo Pacheco (PSD-MG), president of the Senate, praised Bacelar for allowing the creation of the commission, the first in Brazil dedicated to investigating health plans for people with disabilities.

“I find the court’s decision immoral,” Pacheco said. “We need to look at those who need it the most. These mothers and fathers are suffering. These plans are very rich and powerful and employ their own brilliant lawyers, but they can’t win that way: unilaterally.”

The preliminary ruling by Judge Cintia Cardinale, of the TJRJ Special Panel, suspends the CPI until the merits of the Mandamus Order filed by the Brazilian Association of Health Plans are decided. The injunction highlights the potential irreparable damage to the image of health insurance companies.

Basilar said that Allerg’s intention is not to harm the image of brokers, but to reach a suitable agreement and help the families of children with disabilities.

“We knew that messing with those who deal with exorbitant profits, like the health care plans in Brazil, is not an easy task,” said Bacellar. “But we will not lower our heads. Judicial decisions are respected and questioned within the legal limits, with the possibility of appeal. Let us continue to work, and try to help others. I am sure that soon we will be able to reverse this decision and continue working for the people who really need it.”

Alerj installed CPI in June

The CPI was created by a decision of Alerj and was installed in June of this year. Since then, the committee has held six meetings, where it heard from various entities representing health plans, as well as parents and guardians of people with disabilities.

CPI Vice President, Rep. Karla Machado (PT-RJ), stated that group members are still available to families of persons with disabilities.

“Thousands of atypical children are not getting the care they deserve,” said Carla. “Often mothers can’t even make a diagnosis. Many homes are out of balance because no matter how much they love they have no way to help, they have no way to ask for help whether it’s education, health or welfare, in short, it’s real neglect.”
